BrighterBins ("BrighterBins," "we," "us" or "our") is committed to respecting the privacy rights and concerns of all users of the BrighterBins website where this Privacy Policy is posted (the "Site"). As such, we have established and implemented this Privacy Policy to inform visitors to the Site and users of the BrighterBins how we use and protect the information we collect through the Site. By visiting the Site or using any of the BrighterBins features, you consent to BrighterBins’s collection, use, storage, deletion and disclosure of information relating to you as set forth in this Privacy Policy. This Privacy Policy is effective as of the date set forth above and is only applicable to the Site and not to any other website that you may be able to access from the Site which may have its own data collection and use practices and policies.

DIFFERENTIATION BETWEEN DASHBOARD

WHAT IS THE FAMILY TIME – DASHBOARD?

BrighterBins - Dashboard is the parent’s dashboard from which they can monitor their children or the one who they are legal guardians of. It is a dashboard that lets parents view and manage their child’s device usage ad whereabouts. BrighterBins - Dashboard can also be accessed via Web as well as from the mobile application. BrighterBins - Dashboard does not collect any information or log data from the mobile device or computer from which it is being used except for the user’s personal information including the name and email address, which the user has consented being logged. BrighterBins - Dashboard does not collect information like call history, contacts, browser history, installed apps and location details of the Parents using this version of the app. If you think we have unwittingly collected information like call history, contacts, browser history, installed apps and location details from BrighterBins - Dashboard users, please notify immediately on support@brighterbins.io .

To use BrighterBins – Dashboard:

  • You warrant that you are 18 years of age or older.

  • You warrant that you will not use the application for any person for whom you are not the legal guardian.

  • You will not use the Site or Service in violation of any Federal, State or local law, rule, ordinance or governmental regulation.

  • You will only use the Site and Service to monitor the mobile device and location of children for whom you are the legal guardian.

  • You will properly follow all instructions and documentation provided by BrighterBins to you.

  • You will not allow any other person to access the information that the Site and Service collect from the mobile devices on which the Software is installed.

  • You will only install the application in mobile devices for which you are the authorized owner.

More than one parent profiles can be added to your FamilyCircle and for each parent profile; the application will behave the same, i.e. exactly as mentioned above.

WHAT IS BRIGHTERBINS?

BrighterBins, on the other hand, resides on the child’s mobile device and pulls data (call history, contacts, browser history, installed apps and location details) from the device and makes it accessible to the BrighterBins - Dashboard. BrighterBins also lets the child manage user profile and send SOS and PickMeUp alerts to their parent(s). BrighterBins needs to be installed on a child’s mobile device in order to log information and device data and make it accessible to BrighterBins - Dashboard. BrighterBins can only be used by logging into the app and children cannot use it from the Web.

HOW WE COLLECT AND USE INFORMATION

 

BRIGHTERBINS - DASHBOARD

 

PERSONAL INFORMATION

Personal information means information that can be used to identify and contact an individual such as name, email address, screen name, mailing address and phone number (the "Personal Information"). You need to submit Personal Information to create account with BrighterBins - Dashboard and to use BrighterBins features. We collect Personal Information when you create an account through BrighterBins - Dashboard; subscribe to our newsletter; participate in feedback forms and questionnaires; or receive customer or technical support.

To create a BrighterBins - Dashboard account, we require you to provide certain information to create your profile, including a login name and password and your email address, mailing address and phone number. Providing additional information beyond what is required to create an account is entirely optional, but enables you to gain more from the Service. As you add a child’s device to your BrighterBins - Dashboard account, information such as the child’s name, date of birth and relation with you will be required. This information will be used by the Service.

HOW WE USE YOUR PERSONAL INFORMATION

The Personal Information you provide to us will allow us to provide the services available through the Site and the BrighterBins Service; alert you of new products or services, features, or enhancements; handle/route your customer service questions or issues; and/or notify you of upgrade opportunities, or special offers. We also use your email address as part of the BrighterBins Service in sending you messages about the BrighterBins Service and other general announcements.

We keep track of your interactions with us, including but not limited to your activity within the BrighterBins Service. We may use Personal Information you provide to us to send messages to you in response to your request to perform an activity in connection with your use of any of the BrighterBins Service. We may also use your Personal Information to contact you when necessary.

The information that you enter while adding a child’s device (name, date of birth and relation with you) will be stored to create a child profile. The date of birth will determine if parents need to fill and send us the Parental Consent Form. Parents who want to use BrighterBins - Dashboard to monitor children under 13 years, need to give written consent that they acknowledge what information is collected from the their devices.

BRIGHTERBINS Jr.

BrighterBins Jr. (meant for child’s mobile device) collects and provides you access to certain cell phone and online activities (including, but not limited to, call history, contacts, Internet browser history, installed apps, location history) from your child’s phone or tablet on which the BrighterBins software is installed (the “Accessed Activities”). For details on what data we pull from child’s device through BrighterBins, read our App Privacy Policy.

SHARING OF INFORMATION

Unless required by applicable law or legal process or as described below, we do not access, use, or share any information obtained by our servers through your use of the BrighterBins Features, including any Accessed Activities. We may use your Personal Information to provide analyses of our users in the aggregate (including Analytical Data subject to the terms of this Privacy Policy) to prospective partners and other third parties. To the extent we share Personal Information that has not been de-personalized with third parties, we require those third parties to comply with this Privacy Policy and take appropriate confidentiality and security measures. In addition, we will share the Personal Information and Accessed Activities we collect under the following circumstances:

PROTECTION OF RIGHTS

We will access and share your Personal Information or any of the information within the Accessed Activities if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is appropriate to enforce the Terms and Conditions for the BrighterBins Service, including any investigation of potential violations thereof, (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the BrighterBins Service, or (iv) such action is appropriate to protect the rights, property or safety of BrighterBins its employees, users of the BrighterBins Service or others.

ASSET TRANSFERS

If we become involved in a merger, acquisition or other transaction involving the sale of some or all of BrighterBins’s assets, user information, including Personal Information collected from you through your use of the BrighterBins Service, could be included in the transferred assets. You expressly consent to such transfer. Should such an event occur, we will use reasonable means to notify you, either through email and/or a prominent notice on the Site.

SERVICE PROVIDERS

We may employ third-party companies and individuals due to the following reasons:

  • To facilitate our Service;

  • provide the Service on our behalf;

  • To perform Service-related services; or

  • To assist us in analyzing how our Service is used.

We want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

 

COOKIES AND OTHER TRACKING TECHNOLOGIES

INFORMATION LOGGING

Our servers automatically record information that your browser sends whenever you visit the Site. This information includes your Internet Protocol address, your browser type and version, the search engine you used to find the BrighterBins Service, if any, which BrighterBins Service you use and when and how long you use them. We use this information to monitor and analyze how users use the BrighterBins Service, to provide customer service and to maintain and improve the BrighterBins Service.

CHILDREN'S PRIVACY

Children under the age of 13 may not submit personal information to BrighterBins without the consent of their parents. You must be at least 18 years old to obtain an account on this site. We do not knowingly collect personal information from children or sell any products to children. We take children's privacy seriously, and encourage the legal guardians of children to play an active role in their children's online experience at all times. BrighterBins provides you, as a legal guardian of a child or children under the age of 18, with the ability to collect and access the Accessed Activities. You agree and warrant that you will not use BrighterBins to monitor your children of 18 years and above. While BrighterBins - Dashboard grants you access to the Accessed Activities, BrighterBins does not use such information in any way. You are solely responsible for such information accessed by you or any permitted third party using the BrighterBins Service and you agree to the Representations and Warranties of the Terms of Use governing the use of the Site and the BrighterBins Service.

ADDITIONAL INFORMATION YOU SHOULD KNOW ABOUT THIRD PARTIES

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

When you have clicked on a third party logo or URL displayed on our Site which links you to a different website, our Privacy Policy no longer apply and you must read the privacy policy of the third party to see how your Personal Information will be handled on their website.

CONTROL OF YOUR INFORMATION

You may access, update or delete your Personal Information or modify your account preferences for the BrighterBins Service by accessing the "Settings" area of the BrighterBins Service. Please note that when you delete your account, we will delete all information connected to your account including personal details and monitoring data.

OPTING OUT OF RECEIVING COMMUNICATIONS FROM US

If you no longer want to receive our newsletter, emails or other announcements, you may unsubscribe by writing to us at support@BrighterBins.io or replying to the unsubscribe link at the bottom of our emails. Please note that you cannot unsubscribe from certain correspondence from us, including messages relating to your account transactions.

MEDIATION

You agree that, in the event any dispute or claim arises out of or relating to this Privacy Policy that you and BrighterBins will attempt in good faith to negotiate a written resolution of the matter directly between the parties. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorney's fees, even if you would otherwise be entitled to them. The Personal Information that you provide to us is stored on servers, which are located in secured facilities with restricted access, and protected by protocols and procedures designed to ensure the security of such information. In addition, we restrict access to Personal Information to BrighterBins employees who need to know this information in order to develop, operate and maintain the BrighterBins Service. All BrighterBins personnel who have access to this information are trained in the maintenance and security of such information.
However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the use of any of the BrighterBins Service and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems.

NOTIFICATION OF CHANGES

BrighterBins may, in its sole discretion, modify or update this Privacy Policy from time to time, and so you should review this page periodically. When we change the policy, we will update the ‘last modified’ date at the top of this page. If there are material changes to this Privacy Policy or in how BrighterBins will use your personal information, we will notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification.
